Military Detention Law Blocked by New York Judge

Opponents of a U.S. law they claim may subject them to indefinite military detention for activities including news reporting and political activism persuaded a federal judge to temporarily block the measure.

U.S. District Judge Katherine Forrest in Manhattan yesterday ruled in favor of a group of writers and activists who sued President Barack Obama, Defense Secretary Leon Panetta and the Defense Department, claiming a provision of the National Defense Authorization Act, signed into law Dec. 31, puts them in fear that they could be arrested and held by U.S. armed forces.

The complaint was filed Jan. 13 by a group including former New York Times reporter Christopher Hedges. The plaintiffs contend a section of the law allows for detention of citizens and permanent residents taken into custody in the U.S. on “suspicion of providing substantial support” to people engaged in hostilities against the U.S., such as al-Qaeda.

“The statute at issue places the public at undue risk of having their speech chilled for the purported protection from al-Qaeda, the Taliban, and ‘associated forces’ - i.e., ‘foreign terrorist organizations,’” Forrest said in an opinion yesterday. “The vagueness of Section 1021 does not allow the average citizen, or even the government itself, to understand with the type of definiteness to which our citizens are entitled, or what conduct comes within its scope.”

Enforcement Blocked

Forrest’s order prevents enforcement of the provision of the statute pending further order of the court or an amendment to the statute by Congress.

Ellen Davis, a spokeswoman for U.S. Attorney Preet Bharara in Manhattan, declined to comment on the ruling.

The plaintiffs claim Section 1021 is vague and can be read to authorize their detention based on speech and associations that are protected by the First Amendment to the Constitution.

Hedges and two other plaintiffs testified in a hearing before Forrest in March, the judge said. A fourth plaintiff submitted a sworn declaration. The government put on no evidence, Forrest said.

Forrest, an Obama appointee who has served on the Manhattan federal court since October, rejected the government’s arguments that the plaintiffs lacked standing to sue over the law and that it merely reaffirmed provisions in an earlier law, the 2001 Authorization for Use of Military Force, which was passed in the wake of the Sept. 11, 2001, terrorist attacks.

Plaintiffs’ Activities

In her opinion, Forrest said the government declined to say that the activities of Hedges and the other defendants don’t fall under the provision. Forrest held a hearing in March at which government lawyers didn’t call any witnesses or present evidence, according to the judge. The government did cross- examine the plaintiffs who testified and submitted legal arguments.

“The government was given a number of opportunities at the hearing and in its briefs to state unambiguously that the type of expressive and associational activities engaged in by plaintiffs -- or others -- are not within Section 1021,” Forrest said. “It did not. This court therefore must credit the chilling impact on First Amendment rights as reasonable -- and real.”

Hedges, who testified he has been a foreign news correspondent for 20 years, said he has reported on 17 groups that are on a State Department list of terrorist groups. Hedges testified that after the law was passed, he changed his dealings with groups he had reported on, Forrest said.

“I think the ruling was not only correct, but courageous and important,” Hedges said in a telephone interview yesterday.

The case is Hedges v. Obama, 12-cv-00331, U.S. District Court, Southern District of New York (Manhattan).

A Censored Race War?

When two white newspaper reporters for the Virginian-Pilot were driving through Norfolk, and were set upon and beaten by a mob of young blacks -- beaten so badly that they had to take a week off from work -- that might seem to have been news that should have been reported, at least by their own newspaper. But it wasn't.

"The O'Reilly Factor" on Fox News Channel was the first major television program to report this incident. Yet this story is not just a Norfolk story, either in what happened or in how the media and the authorities have tried to sweep it under the rug.

Similar episodes of unprovoked violence by young black gangs against white people chosen at random on beaches, in shopping malls or in other public places have occurred in Philadelphia, New York, Denver, Chicago, Cleveland, Washington, Los Angeles and other places across the country. Both the authorities and the media tend to try to sweep these episodes under the rug as well.

In Milwaukee, for example, an attack on whites at a public park a few years ago left many of the victims battered to the ground and bloody. But, when the police arrived on the scene, it became clear that the authorities wanted to keep this quiet.

One 22-year-old woman, who had been robbed of her cell phone and debit card, and had blood streaming down her face said: "About 20 of us stayed to give statements and make sure everyone was accounted for. The police wouldn't listen to us, they wouldn't take our names or statements. They told us to leave. It was completely infuriating."

The police chief seemed determined to head off any suggestion that this was a racially motivated attack by saying that crime is colorblind. Other officials elsewhere have said similar things.

A wave of such attacks in Chicago were reported, but not the race of the attackers or victims. Media outlets that do not report the race of people committing crimes nevertheless report racial disparities in imprisonment and write heated editorials blaming the criminal justice system.

What the authorities and the media seem determined to suppress is that the hoodlum elements in many ghettoes launch coordinated attacks on whites in public places. If there is anything worse than a one-sided race war, it is a two-sided race war, especially when one of the races outnumbers the other several times over.

It may be understandable that some people want to head off such a catastrophe, either by not reporting the attacks in this race war, or not identifying the race of those attacking, or by insisting that the attacks were not racially motivated -- even when the attackers themselves voice anti-white invective as they laugh at their bleeding victims.

Trying to keep the lid on is understandable. But a lot of pressure can build up under that lid. If and when that pressure leads to an explosion of white backlash, things could be a lot worse than if the truth had come out earlier, and steps taken by both black and white leaders to deal with the hoodlums and with those who inflame the hoodlums.

These latter would include not only race hustlers like Al Sharpton and Jesse Jackson but also lesser known people in the media, in educational institutions and elsewhere who hype grievances and make all the problems of blacks the fault of whites. Some of these people may think that they are doing a favor to blacks. But it is no favor to anyone who lags behind to turn their energies from the task of improving and advancing themselves to the task of lashing out at others.

These others extend beyond whites. Asian American school children in New York and Philadelphia have for years been beaten up by their black classmates. But people in the mainstream media who go ballistic if some kid says something unkind on the Internet about a homosexual classmate nevertheless hear no evil, see no evil and speak no evil when Asian American youngsters are beaten up by their black classmates.

Those who automatically say that the social pathology of the ghetto is due to poverty, discrimination and the like cannot explain why such pathology was far less prevalent in the 1950s, when poverty and discrimination were worse. But there were not nearly as many grievance mongers and race hustlers then.

200 Year Supply Of Oil In One Single Shale Formation

The Green River Formation—an assemblage of over 1,000 feet of sedimentary rocks that lie beneath parts of Wyoming, Utah, and Colorado.

USGS estimates that the Green River Formation contains about 3 trillion barrels of oil. At the midpoint of this estimate, almost half of the 3 trillion barrels of oil would be recoverable. This is an amount about equal to the entire world’s proven oil reserves.

  The Green River Formation, the world’s largest oil shale deposit, is located in a largely vacant region of mostly federal land on the western edge of the Rocky Mountains that includes portions of Wyoming, Utah, and Colorado (see map).

Right now, forces are working to eradicate the United States Constitution and give regulatory and political power to the United Nations and their vision for a global, one-world government.
This is not a conspiracy that MAY happen … it is in place as you read this.

AGENDA 21 is a vast United Nations initiative that may already have been implemented in your town.

In the interest of “saving” the Earth and creating a “sustainable” future, Agenda 21 will dictate:

• What kind of car you can and cannot drive;
• Where and when you can travel;

• What kind of property you can own, if you are allowed to own property;

The American Policy Center reports that Agenda 21 means that:

When it is implemented-and as you read this, it is being put into place in many American towns-Agenda 21 will change the way you live, because it will change the way you are ALLOWED to live.
Global warming environmentalism has reached a new level of hysteria. Despite countless arguments against it, the issue is not going away, and its backers are more rabid than ever.

Agenda 21 seeks to control how Americans live their lives, presumably in an effort to “save the planet” and “sustain” life on Earth. How did this happen? Slowly, and in relative quiet, so you wouldn’t figure out what was happening and try to stop it!

In June, 1992, more than 178 governments-including the United States of America-adopted the Rio Declaration on Environment and Development, and the Statement of Principles for the Sustainable Management of Forests at a United Nations conference in Rio de Janeiro, Brazil.
These were not just typical “go-green” initiatives that would eventually end up being fought through legislation in Congress.
It was the beginning of the systematic destruction of freedom for every American citizen.

After the 1992 conference, President Clinton established a Presidential Council on Sustainable Development in 1995, by executive order. That means you and I did not get an opportunity to reject or support the idea.

This was done by executive order for good reason. J. Gary Lawrence, Council advisor to President Clinton, said:
“Participating in a UN advocated planning process would very likely bring out many of the conspiracy-fixated groups and individuals in our society. … This segment of our society who fear “one-world government” and a UN invasion of the United States…would actively work to defeat [Agenda 21]. So we call our process something else, such as comprehensive planning, growth management or smart growth.”

“…proposes an array of actions which are intended to be implemented by every person on earth. … [I]t calls for specific changes in the activities of all people. … Effective execution of Agenda 21 will require a profound reorientation of all humans, unlike anything the world has ever experienced.”

It sounds like a post-apocalyptic horror film, but this is reality that is unfolding before our very eyes.
The United Nations is no friend to our Constitution and our freedom. Their viewpoint is completely anathema to the hard-fought values and principles this country was built upon.
YOU ARE THE ENEMY, according to the United Nations. Your greedy freedom, democracy, and right to wealth must be stopped!

You may wonder how a global body could overrule your rights as an American…they believe they can do this because they do not respect the rights you hold.
For example, one of Agenda 21′s premises is that private property is “a social injustice since not everyone can build wealth from it.” That is why they have no problem placing property restrictions on residents.
The U.N. Conference on Human Settlements agrees, stating:

“Private land ownership is also a principal instrument of accumulation and concentration of wealth and therefore contributes to social injustice…The provision of decent dwellings and healthy conditions for the people can only be achieved if land is used in the interest of society as a whole.”

The International Council of Local Environmental Initiatives (ICLEI), is the organization implementing all these restrictions. Chances are, your local government is a member. More than 600 U.S. cities are. ICLEI describes itself as “the domestic leader on climate protection and adaptation, and sustainable development at the local government level.”

Cities pay dues to the ICLEI, and the organization doles out training, software, and plans for “sustainable” programs and regulations.

And you will be interested to know that a HUGE supporter of ICLEI is none other than George Soros and his Open Society Foundation. Soros has given millions of dollars to ICLEI to help get them firmly anchored in America.

That means that as you read this, your city or town could be working off rules and regulations dictated by the United Nations, and you have had no say up until this point because you probably didn’t realize what was happening.

William Jasper has been warning people of the U.N. takeover for years. Last year he wrote in The New American,

“The UN’s Agenda 21 is definitely comprehensive and global – breathtakingly so. Agenda 21 proposes a global regime that will monitor, oversee, and strictly regulate our planet’s oceans, lakes, streams, rivers, aquifers, sea beds, coastlands, wetlands, forests, jungles, grasslands, farmland, deserts, tundra, and mountains. It even has a whole section on regulating and “protecting” the atmosphere. It proposes plans for cities, towns, suburbs, villages, and rural areas. It envisions a global scheme for healthcare, education, nutrition, agriculture, labor, production, and consumption – in short, everything; there is nothing on, in, over, or under the Earth that doesn’t fall within the purview of some part of Agenda 21.” 

The Obama administration believes human beings are Earth’s enemy. He has already come out in full support of federal land grabs, and many of his unelected “czars” are pro-global warming and anti-private property rights:

• His Global Warming czar Carol Browner left her post after it was discovered she lied and published misleading information to the public. She was a leader in the Socialist Commission for a Sustainable World Society.
• His Science czar John Holdren authored a book advocating forced abortions and mass sterilization.
• His Regulatory czar Cass Sunstein wrote that animals should have the right to sue humans for neglect.
• His Green Jobs czar Van Jones was discovered to be a Marxist who believed that 9/11 was an inside job.

This is not an administration that is going to protect us from United Nations encroachment.
America is in grave crisis. Welcome to your new religion: sustainability. Maurice Strong, head of the U.N. Environment Program believes that the Earth Charter (part of which governs the theories of Agenda 21) should be elevated to the same level as the Ten Commandments.

The Canada Free Press warns that Agenda 21 is property theft. They ask, “Why would any American want to give the UN control over vast amounts of U.S. land?

The answer is, OF COURSE WE DON’T WANT THAT! But our government is working right now to make that happen. And unless we flood our representatives with opposition, there will be no way to stop it. 

Communities are fighting back against the ICLEI in Virginia, Oklahoma, Pennsylvania, Tennessee, Nebraska, Texas, California, and many more. Concerned citizens and alert Tea Parties are leading the charge.

To win this, we will require a strong nationwide effort. The U.N. will not go quietly, and they will continue their drumbeat in the name of “sustainability.”
