Too little too late

Delay instead of defund; too little too late.

The House of Representatives passed a bill defunding Obamacare, but on Friday, the Senate restored the funding.  Of course everyone knew that is exactly what would happen.   That’s the reason only the Democrats and the RINOs voted to end the debate and bring the bill to a vote.

Over the weekend, the House responded by sending the Senate a spending bill that would keep the government running past the Sept. 30 deadline, but would also delay implementing Obamacare by a year.
Some Republicans think that is the wrong move — they believe the health care law should be implemented immediately because it will be such a disaster, voters will make Democrats pay for it at the polls in the 2014 elections.  Don’t hold your breath; a lot of them are not up for re-election until 2016.   By that time it will have evolved into a 100% government socialized healthcare program and it will be much too late to do anything about it. 

I do agree that we need to mak’em pay when they come up for re-election, but unfortunately, we will forever be stuck with this monstrosity we call ObamaCare…

Well, I have done it! I have read the entire text of proposed House Bill
3200: The Affordable Health Care Choices Act of 2009. I studied it with
particular emphasis from my area of expertise, constitutional law. I was
frankly concerned that parts of the proposed law that were being discussed
might be unconstitutional.
What I found was far worse than what I had heard or expected.

To begin with, much of what has been said about the law and its implications
is in fact true, despite what the Democrats and the media are saying. The
law does provide for rationing of health care, particularly where senior
citizens and other classes of citizens are involved,freehealth care for illegal
immigrants, free abortion services, and probably forced participation in
abortions by members of the medical profession.

The Bill will also eventually force private insurance companies out of
business, and put everyone into a government run system. All decisions about
personal health care will ultimately be made by federal bureaucrats, and
most of them will not be health care professionals. Hospital admissions, payments
to physicians, and allocations of necessary medical devices will be strictly
controlled by the government.

However, as scary as all of that is, it just scratches the surface. In fact,
I have concluded that this legislation really has no intention of providing
affordable health care choices. Instead it is a convenient cover for the
most massive transfer of power to the Executive Branch of government that has
ever occurred, or even been contemplated. If this law or a similar one is
adopted, major portions of the Constitution of the
United States will effectively
have been destroyed.

The first thing to go will be the masterfully crafted balance of power
between the Executive, Legislative, and Judicial branches of the U.S.
Government. The Congress will be transferring to the Obama Administration
authority in a number of different areas over the lives of the American
people, and the businesses they own.

The irony is that the Congress doesn't have any authorityto legislate in
most of those areas to begin with! I defy anyone to read the text of the U.S.
Constitution and find any authority granted to the members of Congress to
regulate health care.

This legislation also provides for access, by the appointees of the Obama
administration, of all of your personal healthcaredirect violation of the
specific provisions of the 4th Amendment to the Constitution information,
your personal financial information, and the information of your employer,
physician, and hospital. All of this is a protecting against unreasonable
searches and seizures. You can also forget about the right to privacy. That
will have been legislated into oblivion regardless of what the 3rd and 4th
Amendmentsmay provide.

If you decide not to have healthcare insurance, or if you have private
insurance that is not deemed acceptable to the Health Choices Administrator
appointed by Obama, there will be a tax imposed on you. It is called a tax
instead of a fine because of the intent to avoid application of the due
process clause of the 5th Amendment. However , that doesn't work because
since there is nothing in the law that allows you to contest or appeal the
imposition of the tax,it is definitely depriving someone of property without
the due process of law.

So, there are three of those pesky amendments that the far left hate so
much, out the original ten in the Bill of Rights, that are effectively nullified
by this law. It doesn't stop there though.

The 9th Amendment that provides: The enumeration in the Constitution, of
certain rights, shall not be construed to deny or disparage others retained
by the people;

The 10th Amendment states: The powers not delegated to the United States by
the Constitution, nor prohibited by it to the States, are preserved to the
States respectively, or to the people. Under the provisions of this piece of
Congressional handiwork neither the people nor the states are going to have
any rights or powers at all in many areas that once were theirs to control.

I could write many more pages about this legislation, but I think you get
the idea. This is not about health care; it is about seizing power and limiting
rights. Article 6 of the Constitution requires the members of both houses of
Congress to "be bound by oath or affirmation to support the Constitution."
If I was a member of Congress I would not be able to vote for this legislation
or anything like it, without feeling I was violating that sacred oath or
affirmation. If I voted for it anyway, I would hope the American people
would hold me accountable.

For those who might doubt the nature of this threat, I suggest they consult
the source, the US Constitution, and Bill of Rights. There you can see
exactly what we are about to have taken from us.

Who Is Racist?

I am so old that I can remember when most of the people promoting race hate were white. 

Apparently other Americans also recognize that the sources of racism are different today from what they were in the past. According to a recent Rasmussen poll, 31 percent of blacks think that most blacks are racists, while 24 percent of blacks think that most whites are racist.

The difference between these percentages is not great, but it is remarkable nevertheless. After all, generations of blacks fought the white racism from which they suffered for so long. If many blacks themselves now think that most other blacks are racist, that is startling.

The moral claims advanced by generations of black leaders -- claims that eventually touched the conscience of the nation and turned the tide toward civil rights for all -- have now been cheapened by today's generation of black "leaders," who act as if it is all just a matter of whose ox is gored.

Even in legal cases involving terrible crimes -- the O.J. Simpson murder trial or the charges of gang rape against Duke University students -- many black "leaders" and their followers have not waited for facts about who was guilty and who was not, but have immediately taken sides, based on who was black and who was white.

Among whites, according to the same Rasmussen poll, 38 percent consider most blacks racist and 10 percent consider most whites racist.

Broken down by politics, the same poll showed that 49 percent of Republicans consider most blacks racist, as do 36 percent of independents and 29 percent of Democrats.

Perhaps most disturbing of all, just 29 percent of Americans as a whole think race relations are getting better, while 32 percent think race relations are getting worse. The difference is too close to call, but the fact that it is so close is itself painful -- and perhaps a warning sign for where we are heading.

Is this what so many Americans, both black and white, struggled for, over the decades and generations, to try to put the curse of racism behind us -- only to reach a point where retrogression in race relations now seems at least equally likely as progress?

What went wrong? Perhaps no single factor can be blamed for all the things that went wrong. Insurgent movements of all sorts, in countries around the world, have for centuries soured in the aftermath of their own success. "The revolution betrayed" is a theme that goes back at least as far as 18th century France.

The civil rights movement in 20th century America attracted many people who put everything on the line for the sake of fighting against racial oppression. But the eventual success of that movement attracted opportunists, and even turned some idealists into opportunists.

Over the generations, black leaders have ranged from noble souls to shameless charlatans. After the success of the civil rights insurgency, the latter have come into their own, gaining money, power and fame by promoting racial attitudes and actions that are counterproductive to the interests of those they lead.

None of this is unique to blacks or to the United States. In various countries and times, leaders of groups that lagged behind, economically and educationally, have taught their followers to blame all their problems on other people -- and to hate those other people.

This was the history of anti-Semitic movements in Eastern Europe between the two World Wars, anti-Ibo movements in Nigeria in the 1960s, and anti-Tamil movements that turned Sri Lanka from a peaceful nation into a scene of lethal mob violence and then decades-long civil war, both marked by unspeakable atrocities.

Groups that rose from poverty to prosperity seldom did so by having racial or ethnic leaders. While most Americans can easily name a number of black leaders, current or past, how many can name Asian American ethnic leaders or Jewish ethnic leaders?

The time is long overdue to stop looking for progress through racial or ethnic leaders. Such leaders have too many incentives to promote polarizing attitudes and actions that are counterproductive for minorities and disastrous for the country.

Senator Cruz tells the truth




Sen. Cruz is scaring a lot of the political “elite” ruling class these days…by speaking the truth and making certain the American people understand it.
Sen. Cruz tells the truth that both political parties in this country have failed the people. In order to gain more and more power, members of both parties have all but eliminated We-the-People from our own government. And, by leaving the running of government solely to others, We-the-People have abrogated our own checks and balances responsibilities and allowed it to happen. Via our lack of attention, we have allowed our elected officials to reach the point where they are now ruling over us…not governing. US laws are being broken daily, now, by all 3 branches of the federal government and the US Constitution was thrown out by them years ago.

 They now rule only to gain more power and wealth; both of which they have now openly and unceremoniously stolen from us. We will never get it back unless we fight for it. Each day that we fail to act and, also, kick the can down the road our rulers gain more illegal authority over us. This is how dictatorships, oligarchies and police-slave states are created. We are now well into the implementation phase of all. If we are no longer willing to stand up and support men and women with the tenacity, integrity, honor, intelligence and passion for our Constitution as does Senator Ted Cruz, then perhaps we don’t deserve to survive as a country after all.

During the 21 hour and 18 minute dissertation by Senator Cruz to the American people and to his own colleagues, he was joined by a few of his colleagues who assisted him by asking pertinent questions on the Senate floor.  These few included Sen. Mike Lee (R-UT), Sen. Rand Paul (R-KY), Sen. Marco Rubio (R-FL). Cruz was, later, joined by Sen. James Inhofe (R-OK) and, briefly, by Sen. Chuck Grassley (R-IA).

But, as of this morning, Sen. Cruz is still being belittled, denigrated and disparaged by the now fully-out-of-the-closet Communist press, Democrats and RINOs in Congress. Democrats and Communists hate this man. That’s understood. Neither of those groups support either the truth or those who tell it. RINOs, however, despise Senator Cruz because, by telling said truth, he brings their own short-comings—if not abject corruption—into the light of day…so all can see. Those of the Sen. John McCain ilk came out of that faux conservative and anti-US Republic long ago.   However, for those who followed and supported the ever-bombastic, pro-Islam and, apparently, pro-ObamaCare Rep. Peter King (R-NY) it has come as a bit of a shock.

I have a simple question for all members of Congress (of both parties) who say Ted Cruz Can’t win: HOW WELL IS YOUR STRATEGY WORKING OUT? 

We the Ameican voters intended the 2010 election as a restraining order on the Democrats, and victorious Republicans embraced it as such.  But in reality, they can’t or won’t restrain anything.  They can’t stop funding for ObamaCare.  They can’t force the passage of real budgets.  They can’t stop the Democrats from continuing to treat the “one-time emergency” stimulus of 2009 as part of the budget baseline.  They can’t do any of that until they get control of the Senate too.


Well, I’m not buying it, because, by law the government can’t spend any money on anything unless both houses of Congress pass it, which it seems to me would give tremendous restraining power to the Republican-controlled House.

We are told by Republicans in Congress to embrace restraint and caution, because Ted Cruz’s strategy of defunding ObamaCare cannot work.  Well, like I ask before, What, exactly, has the cautious, realistic strategy of McConnell, Boehner and Cantor accomplished?  Are we getting real budgets?  Is spending being restrained?  Has ObamaCare been slowed in the slightest?  Has the Keystone XL pipeline been approved? Have the attacks on the coal industry lessened?

I can think of one thing, and one thing only, this crew has achieved, and that is that MOST of the Bush tax cuts were made permanent.  But the attacks on wealth and job creators will continue unabated, so it’s a pretty limited victory.  And a tax rate is “permanent” only until Congress changes it, so don’t believe for a second those lower tax rates will be treated as “permanent” if Democrats regain the House majority in 2014.

Overall, the Republican leadership in the House has made a choice to pursue a timid, make no waves strategy against Obama and his policies.  They could have done much more.  They could have started on Day 1 of 2011 by declaring that the endless parade of continuing resolutions was over, that spending would be returned to pre-“emergency” levels, and that the Democrats would have to make major concessions on ObamaCare and a whole host of other things if they wanted their major priorities funded.  Had they made that declaration and stuck to it, instead of being constantly terrified over what the media would say about them, we would not be in a position today where Ted Cruz and his small group of allies have to fight in the manner in which they are.

You can never get anything done if you make up your mind that you’re scared to try, and that’s how most of the Republican leadership in Washington has operated for the past three years.  Not only are they scared to try, they’re scared of anyone else trying because it will get them criticized and “damage the Republican brand” or whatever.

Their frightened approach to governing hasn’t accomplished much of anything, so they have a hell of a lot of nerve criticizing Ted Cruz for actually wanting to fight.  My advice to all Republicans in both the House and the Senate who wish to keep their job is: Grow a pair and follow the lead of Ted Cruz rather than criticizing him.

VOTER ID


Just prior to the last presidential election, the Pennsylvania state Supreme Court blocked enforcement of the voter identification law because of lingering concern that it could disenfranchise voters who lacked a valid photo ID.  The exact same thing happened in several other states.

Any judge handing down such a ridiculous decision needs to be removed from office.   You need photo identification to buy or rent a car, buy a house, rent an apartment, get a job, start a bank account, drive, in many cases, even to purchase a movie ticket,.  If fact, you need a proper ID for everything I can think of except to vote.   Every country on the planet that has elections REQUIRE that you present Identification before you can vote, except the USA.   So what’s the problem, why are we such a primitive country?

The answer is, the Democrats don’t want ID laws on the books, and we all know why.   Because Photo ID’s reduce fraud and helps to keep elections fair.  Those who are blocking ID laws don’t want fair elections. They don’t want fair elections because they benefit from fraud.  

If it’s this obvious to me, why isn’t it to everybody else?  The truth is, it IS obvious to everybody else.

To be a part of the economic mainstream of this country, it is necessary to have a valid photo ID.  So here’s a question for Democrats and the news media.  If it’s racist to ask voters for a form of identification at their polling place, why isn’t it then racist to also ask for identification before stepping inside a plane, or into a federal building, filling out a job application or opening up a bank account?

The right to vote is the most FUNDAMENTAL right and privilege we have as U.S. Citizens.  I don’t care what color or ethnicity anybody is, the right to vote was paid for by the blood of Americans.  If you can’t respect that enough to make an effort to get a photo ID so you can vote, you obviously are clueless on how and why this country was founded.  An overwhelming majority is in favor of voter ID laws.
 
But, on the down side, voter ID laws won’t eliminate ALL voter fraud in the “blue states” because if voters were required to show ID your democratically run state drivers license bureau would be used to produce hundreds of thousands of fake IDs for use by democrat operatives active in the fraud.   It’s easy, you can register to vote and get a drivers license at the DMV.  But that’s no excuse for not doing everything we can to reduce fraud and make our elections a fair as possible.

The 2.3% Medical Excise Tax that began on January 1st is supposed to be "hidden" from the consumer, but it's been brought to the public's attention by hunting and fishing store Cabela's who have refused to hide it and are showing it as a separate line item tax on their receipts, the email states.
This is an image of a sales receipt from Cabela's, a popular sporting goods store with almost 50 locations throughout the US They also have mail order and internet sales.




I did some research and found directly from the IRS's website information that PROVES this to be true and an accurate portrayal of something hidden in Obamacare that I was not aware of! Now being skeptical of this I went to the IRS website and found this!

Q1. What is the medical device excise tax?
A1. Section 4191 of the Internal Revenue Code imposes an excise tax on the sale of certain medical devices by the manufacturer or importer of the device.

Q2. When does the tax go into effect?
A2. The tax applies to sales of taxable medical devices after Dec. 31, 2012.

Q3. How much is the tax?
A3. The tax is 2.3 percent of the sale price of the taxable medical device.
